HSRA

The Hazardous Site Response Act (HSRA) was enacted within the State of Georgia to address environmentally impacted properties that had not been addressed under existing Federal and State environmental programs. This program requires owners of properties to notify the State of Georgia if they become aware of any impacts to soil and groundwater that may impact the property. Under certain conditions, these properties may be placed on the State of Georgia, Hazardous Sites Inventory (HSI), which results in protracted investigations and possible remediation of these impacts. Based on these developments, it is important there is a through understanding of the rules and notification requirements in order to develop cost effective solutions raised in HSRA.

On May 5, 2009, the Georgia Voluntary Remediation Program (VRP) was signed into law to provide a fast-track method to voluntarily clean up contaminated sites in Georgia, including those sites already placed on HSI. This program allows several important features to owners including the privatization of the program (less regulatory involvement); and the development of site-specific risk based corrective action levels for soil and/or groundwater remediation.
